Sezzle Subscription Terms

These Sezzle Subscription Terms (“Subscription Terms”) apply to Sezzle subscription services of Sezzle Premium and Sezzle Anywhere (each, a “Subscription”) issued by Sezzle Inc. (“Sezzle,” “we,” or “our”) , Subscription Terms incorporate the Sezzle User Agreement (“User Agreement”), including its Arbitration Provision. Capitalized terms used but not defined in these Subscription Terms shall have the meanings given in the User Agreement.

1. Sezzle Subscriptions Benefits

1.1 Sezzle Premium Subscription

A Sezzle Premium subscription gives you access to new features, exclusive merchants, priority support, special deals and discounts, and one (1) free payment reschedule per Order.

1.2 Sezzle Anywhere Subscription

A Sezzle Anywhere subscription includes all the benefits of a Sezzle Premium subscription. With Sezzle Anywhere, you also earn Sezzle Spend for Pay-in-Full purchases and other benefits like access to use the Services at Merchants where Visa is accepted by utilizing the Multi-Use Card to apply for credit, subject to applicable law, network rules, and other terms and conditions set forth in the User Agreement and herein.

Sezzle Anywhere also gives you access to apply for SezzleCash, an advance of a percentage of your estimated spending power to your bank account or debit card. Repayment of your SezzleCash may be required in full within a short-term period (such as approximately 14 days) or, depending on your eligibility, through biweekly installment payments over a longer period (such as 4 or 5 payments). Your available repayment options and any associated fees required to obtain your SezzleCash will be presented to you before you accept your SezzleCash and clearly outlined in your Loan Agreement.

SezzleCash is subject to the SezzleCash User Terms, including its eligibility requirements. Advances and repayment options are not guaranteed and are provided at Lender’s sole discretion.

Sezzle or any of its lending partners that may originate loans through the Services reserve the right to restrict or reject any Order, including but not limited to any Order that in our or their sole discretion is prohibited under the Sezzle Acceptable Use Policy.

2. Subscription Eligibility

Sezzle offers Subscriptions to select customers. At a minimum, to be eligible for a Subscription, you must have an Account and be a resident of the United States or its territories. If you have an Account that has (i) delinquent payments, (ii) been deactivated or terminated for any reason, or (iii) suspended or placed on hold for any reason, you will not initially be permitted to enroll in a Subscription.

All subscription benefits provided under this Agreement are limited to the Account holding the Subscription.

2.1 Subscription Status

Enrollment in a Subscription does not guarantee you will be approved for an Order. Your Subscription does not entitle you to a specific amount of Estimated Spending Power or an extension of credit at specific intervals. Any extension of credit you obtain is governed by the Loan Agreement that is provided to you separately.

If you have a failed payment on an outstanding Order, have a rescheduled payment, or are suspected of fraud, you will be unable to make any new Orders using your Subscription until all payments have been made and any outstanding or delinquent balances have been paid and/or issues resolved in your favor.

3. Subscription Fees

Each Subscription is an automatically renewing subscription service subject to a recurring fee as set forth in Sezzle Licenses, Fees and Subscriptions.

4. Changes to Subscription Terms

Sezzle reserves the right to change or modify the Subscription offerings with or without notice, to the extent permitted by applicable law. Subscription prices and features may change in the future. Sezzle reserves the right to add and modify subscription fees. If we change the fee charged for a Subscription, we will notify you and provide you with the opportunity to change your Subscription before the Subscription is renewed for another term. Your continued use of the Services after the change becomes effective will constitute your acceptance of the fee change. If you do not wish to continue subscribing with the new fees, you should cancel your Subscription as set forth in Section 8. Any Subscription will be subject to the Subscription Terms in effect at the time you sign up or your Subscription renews. We may also make such changes with respect to current Subscriptions. In that case, we will provide you with notice via email of the changes and when those changes will take effect. If you disagree with the changes to your current Subscription Terms, you may cancel your Subscription.

5. Subscription Payment Dates

Subscriptions are offered for intervals that vary (i.e. a monthly or an annual Subscription), which will be displayed at the time of sign-up (the “Enrollment Date”). The Subscription fee is payable on the Enrollment Date. By signing up for a Subscription and providing us your payment account information, you agree that (i) you will be charged your first Subscription fee and any applicable taxes on the Enrollment Date and (i) you will be charged the then-current Subscription fee on the monthly or yearly anniversary of your Enrollment Date, as applicable (each, a “Subscription Payment Date”), unless you or we cancel your Subscription.

6. Payment Authorization; Recurring Payments

You agree to make recurring payments of the Subscription fee on the Subscription Payment Date automatically. UNLESS YOU CANCEL, BY DEFAULT (AND WITH PRIOR NOTICE ONLY TO THE EXTENT REQUIRED BY APPLICABLE LAW), YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW ON THE SUBSCRIPTION PAYMENT DATE, AND WE WILL AUTOMATICALLY CHARGE THE THEN-CURRENT SUBSCRIPTION FEE AND ANY APPLICABLE TAXES TO ANY ELIGIBLE PAYMENT METHODS THAT WE HAVE ON FILE FOR YOU. RENEWAL OF THE SUBSCRIPTION AND ASSOCIATED CHARGES WILL OCCUR ON THE SUBSCRIPTION PAYMENT DATE. YOU CAN CHECK THIS DATE IN THE SEZZLE MOBILE APP UNDER MEMBERSHIP DETAILS.

6.1 Payment Methods

You may use a debit card or credit card, as your preferred payment method to pay a Subscription Fee. Your payment method can be changed, modified or terminated in the Sezzle Mobile App or by logging in to your Sezzle customer dashboard.

6.2 Correction of Errors; Credits

In the event we make an error in processing a payment for a Subscription fee, you authorize them to correct the error by initiating a credit or debit to the payment method on file in the amount of such error on or after the date such error occurs. If you are owed a refund or credit under these Subscription Terms for any reason, you agree that we may issue you a refund for any amounts owed to you by crediting your payment method on file.

6.3 Rejected or Reinitiated Payments

If you have not canceled your Subscription, we will attempt all card payment methods on file for up to thirty (30) days after the Subscription Payment Date. If you would like to use a different payment method or if there is a change in payment method, update your payment and billing information in your Account.

7. Subscription Renewal and/or Cancellation

A Subscription will auto-renew on the Subscription Payment Date until cancelled by you or us. Your Subscription will automatically renew unless your Account has been: (i) deactivated or terminated for any reason or (ii) suspended or placed on hold for any reason.

You can cancel your Subscription through the Sezzle Mobile App or by logging in to your Sezzle customer dashboard. You must cancel at least two (2) days before the next Subscription Payment Date to avoid being charged for the next Subscription period (e.g., if renewal date is January 10, you must cancel by 11:59:59 pm ET on January 8).

FOR ANNUAL SUBSCRIBERS ONLY, if you cancel your Subscription within the first 48 hours and have not placed an eligible Order during that period, we may, in our sole discretion, refund your Subscription fee. Except as otherwise stated, if you cancel your Subscription, you will not receive a refund, but you can continue to enjoy the Subscription and other included benefits through the end of your then-current Subscription period.

8. Trial or Promotional Subscriptions

From time to time, Sezzle may offer some customers trial or other promotional subscription discounts. Such trial or promotional subscriptions are subject to these Subscription Terms and the User Agreement. Free trials will be as indicated in the respective promotion but, in no event, longer than one (1) month (“Trial Period”). BY SIGNING UP FOR SUCH A TRIAL OR PROMOTIONAL SUBSCRIPTION, YOU UNDERSTAND THAT WHEN YOUR FREE TRIAL PERIOD HAS EXPIRED, YOUR SUBSCRIPTION WILL AUTOMATICALLY CONVERT INTO A PAID SUBSCRIPTION, AND WE WILL CHARGE YOUR PAYMENT METHOD(S) THE APPLICABLE FEE. If you cancel the Subscription before the Trial Period has expired, we will not charge you for the Subscription. At the conclusion of the respective Trial Period, you will be charged the Subscription fee, as indicated in the respective promotion. If you purchase a Subscription or upgrade your existing Subscription with a promotional code, each time your Subscription renews, you will be charged the full billing amount. Only one trial or promotional Subscription is available per Account. If your Subscription is ever canceled for any reason, you shall not be eligible for a free trial on any subsequent Subscription. Your Subscription will continue to renew until canceled. Please see Section 7 “Subscription Renewal and/or Cancellation” above.

9. Third Party Benefits

If you signed up for an additional third-party benefit not provided by Issuers, you will need to contact the third party to cancel your membership through them or receive any refund under their applicable policies. Subscriptions redeemed through a gift code or promotional code are not refundable.

10. No Transfer or Assignments; Cancellations by Issuers; Change in Terms

You cannot transfer or assign any Subscription. Issuers reserve the right to accept, refuse, suspend, or cancel your Subscription at any time in their sole discretion. Issuers may change Subscription Terms from time to time. By continuing to participate in a Subscription you accept and agree to any changes in Subscription Terms. If you do not agree to any change, you should cancel your Subscription.
